These large campaign contributions are made so personal injury lawyers can argue medical malpractice cases in front of the very judges whose election they made possible...

 

And it is those same judges who have the power to block medical liability tort reform...

Crucial May 15 Supreme Court And Superior Court Elections May Shape Medical Liability Reform

Although judicial election voter turnout is typically low, these races are extremely important to physicians. Personal injury lawyers pour vaults of cash into judicial races. Why? It is their hope to argue future medical liability lawsuits in front of the very judges whose victories they funded.

The Pennsylvania Supreme Court pauses each year to spin medical liability numbers to the general public to give the illusion that the medical liability crisis is over. The court points out medical malpractice cases are down and claim "reforms" in Pennsylvania are working. But what they fail to disclose is that the number of doctors within those cases continue to increase. The Pennsylvania Trial Lawyers Association (PaTLA) has packed the state Supreme Court, the Pennsylvania Legislature, and the governor's mansion. Those whose elections PaTLA funded are deeply indebted to PaTLA.

Pennsylvania tort reform is a very real possibility. However, we will never change the mind of the judges, legislators and governors who are beholden to the trial bar. The only way tort reform will be achieved is by removing elected officials who are against reform, and by electing candidates who support tort reform.

Examining campaign contributions is a key way of determining who is against tort reform-or who may be likely to be indebted to the trial bar. The following report will help you make a wiser decision when going to the polls on May 15.


CANDIDATES FOR JUSTICE OF THE (PENNSYLVANIA) SUPREME COURT

Mike Krancer (R) - Candidate Mike Krancer has approached P.A.P.A. to indicate his concern about Pennsylvania's hostile medical liability climate. He pledged he will not take campaign contributions from medical malpractice attorneys, PaTLA, or special interests groups that are against medical liability tort reform. Krancer also pledged that if elected he will not legislate from the bench.

Maureen Lally-Green (R) - Candidate Maureen Lally-Green has accepted a $5,000 contribution from Shanin Specter. Having won numerous multimillion dollar medical malpractice verdicts and settlements, Specter is one of the top litigators against physicians in Pennsylvania. His father Arlen Specter is the top tort reform obstructionist in the United States Senate.

Paul Panepinto (R) - Candidate Paul Panepinto has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won multimillion dollar verdicts and/or settlements. Some of those attorneys belong to law firms are lauded by the Philadelphia Trial Lawyers Association as "Stalwart Firms."

Thomas Saylor (Retention) - Judge Thomas Saylor has accepted substantial contributions from aggressive medical malpractice attorneys. A contributing trial lawyer Gerald McHugh is past president of the Pennsylvania Trial Lawyers Association and has been named a "Philadelphia Super Lawyer." His firm has won multimillion dollar verdicts and settlements to include an arbitration verdict of nearly $1 BILLION.

Darnell Jones II (D) - Candidate Darnell Jones has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won multimillion dollar verdicts and/or settlements. Jones is endorsed by Governor Ed Rendell, who is a strong opponent of medical liability tort reform.

Seamus McCaffery (D) - Candidate Seamus McCaffery has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won multimillion dollar verdicts and/or settlements. McCaffery has also accepted a contribution from Alan Rothenberg who aggressively advertises for medical malpractice plaintiffs.

Debra Todd (D) - Candidate Debra Todd has accepted substantial contributions from aggressive medical malpractice attorneys. A contributing trial lawyer Gerald McHugh is past president of the Pennsylvania Trial Lawyers Association and has been named a "Philadelphia Super Lawyer." His firm has won multimillion dollar verdicts and settlements to include an arbitration verdict of nearly $1 BILLION.

CANDIDATES FOR JUSTICE OF THE (PENNSYLVANIA) SUPERIOR COURT

Cheryl Allen (R) - Candidate Cheryl Allen has not accepted contributions from medical malpractice attorneys, PaTLA, or special interests groups that are against medical liability tort reform. Allen supports medical liability tort reform. She has told P.A.P.A. " I believe that the public at large (as well as the medical profession) has been harmed by the proliferation of frivolous medical malpractice lawsuits."

Bruce Bratton (R) - Candidate Bruce Bratton has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won large verdicts and/or settlements.

Jacqueline Shogan (R) - Candidate Jacqueline Shogan has no record of accepting contributions from medical malpractice attorneys, PaTLA, or special interests groups that are against medical liability tort reform at the time of compiling this report.

Michael Joyce (Retention) - Judge Michael Joyce has accepted contributions from aggressive medical malpractice attorneys.

James DeLeon (D) - Candidate James DeLeon has accepted at least one contribution from a medical malpractice attorney.

Christine Donohue (D) - Candidate Christine Donohue has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won multimillion dollar verdicts and/or settlements.

Ron Folino (D) - Candidate Ron Folino has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won multimillion dollar verdicts and/or settlements.

Anne Lazarus (D) - Candidate Anne Lazarus has accepted substantial contributions from aggressive medical malpractice attorneys whose firms have won multimillion dollar verdicts and/or settlements.
