AFA of PA ACTION ALERT
Subcommittee Holds “Hearing” on Employment Non-Discrimination Act – ENDA -- . . . . or at least that what they called it!
On Wednesday the House Subcommittee on Health, Employment, Labor and Pensions heard very biased testimony during what was called ‘hearings’ on ENDA. All witnesses except one spoke in favor of H.R. 2015 which would add ‘actual or perceived sexual orientation or gender identity’ to employer non-discrimination laws. Of course, one reason for this could be the fact that the Human Rights Campaign, a national homosexual group, helped put the panel of witnesses together.
This is yet another attempt to hijack the civil rights movement – equating homosexuality, bisexuality and transgenderism to skin color and nationality as immutable or unchangeable characteristics.
Here are a couple definitions found in H.R. 2015:
GENDER IDENTITY- The term `gender identity' means the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual, with or without regard to the individual's designated sex at birth.
SEXUAL ORIENTATION- The term `sexual orientation' means homosexuality, heterosexuality, or bisexuality.
This bill includes a very narrow religious exemption: “This Act shall not apply to any of the employment practices of a religious corporation, association, educational institution, or society which has as its primary purpose religious ritual or worship or the teaching or spreading of religious doctrine or belief.”
Note “has as its primary purpose religious ritual or worship” has been interpreted by legal counsel that Christian schools would not be totally exempt and would be required to hire homosexual, bisexual and transgender English, Math, History teachers – or any other class that’s primary purpose was not religious.
There is still an opportunity to submit testimony concerning this bill. If you have children or grandchildren who attend a Christian school, please consider submitting written testimony expressing your concerns to the House Subcommittee on Health, Employment, Labor and Pensions by September 14th. Do you know a Christian school administrator that you could contact?
For Christian business owners there is absolutely no exemption; they would be required by law to hire homosexuals, bisexuals and transgender individuals. Even large pro-family organizations such as Focus on the Family, Coral Ridge Ministries and the American Family Association would be required by law to hire such people.
Oh, and Congress seems to have thought of ‘everything’ – even showers, dressing rooms and bathrooms:
“Nothing in this Act shall be construed to establish an unlawful employment practice based on actual or perceived gender identity due to the denial of access to shared shower or dressing facilities in which being seen fully unclothed is unavoidable, provided that the employer provides reasonable access to adequate facilities that are not inconsistent with the employee's gender identity as established with the employer at the time of employment or upon notification to the employer that the employee has undergone or is undergoing gender transition, whichever is later.” – Section 8 (3).
